If Preston has worked hard to protect his relationship, he probably shouldn’t have sent me all kinds of text messages that were never off-the-record.

What occurred at the coffee shop: Preston drove around Java Brewing Company probably 20 or 30 times, repeatedly looking into windows. Which was quite interesting.

Ken Herndon was stupid to believe I wouldn’t publish everything I had. I quashed the subpoena with my attorney, Kif Skidmore, the infamous Lexington counsel you mention. (She happens to be one of the foremost attorneys in the country when it comes to media and freedom of speech.) Primarily because I wasn’t notified in a timely manner and because it was ridiculous for either you or Ken Herndon to think I’d squeal on my sources.

No date was rescheduled, as Herndon’s attorneys didn’t file appropriate paperwork and I was *never* notified. But nice spin.

And, no, I wasn’t set to be in Washington, D.C. I was tending to family.

I’d love nothing more than to be called. Because I have a lot of things to say that neither you nor Ken Herndon want to be public record in the form of a deposition. There is so, so, so much I’ll say. But I’d bet money you’re going to scramble to keep me quiet because it’ll fuck both of your political worlds up. (Not the least of which is the prevailing opinion among several former Herndon supporters and a prominent union printer that Ken knew well in advance of the anti-gay mailer and then attempted to spin things his way.)

According to Herndon’s counsel – and Jim King – they did not have his polygraph examination results prior to my publication.

I still think you should be ashamed for not having the balls to stand up to Jennifer Moore. You let me to do your dirty work. And now that you’re standing behind Ken’s retarded ass witch hunt – one that has forced you to ditch people who have been loyal to you for nearly your entire adult life – you should be even more ashamed. But that’s just my opinion.

Actually that isn’t what you wrote and unless you “bcc’d” Ken, it was directed to me alone.

Also, you didn’t summarily quash the subpoena at all. I’m not sure why you believe you did. You were subpoenaed because Herndon’s counsel thought you might have something more to offer. According to your Lexington counsel, you were to be out of town for a period of time, I believe in Washington DC, and she rescheduled your depo for later date in May; such date was later withdrawn by Herndon’s counsel. Although it is unlikely, you may still be called as the case it yet underway to my knowledge. Your subpoena was recalled since the only information you had was the lie-detector test, something Herndon’s counsel had already been provided by King’s counsel before you published it in your blog.

I am hopeful that Ken will bring the investigation to a close, but I am also hopeful that he only does so after all avenues of information have been travelled. Although he was the only person to bring a case, he wasn’t the only person injured by that mailer.

Lest anyone think I’m exaggerating, they were, indeed, attempting to discover my sources as they questioned Denise Bentley and others during depositions about whether or not they’d ever spoken with me and what they’d spoken with me about.

I’ve been proudly showing off this photo for years. I’m surprised that neither of you have ever seen it. The photo in question is on a University of Louisville ID card taken the summer of 1980 when I was 19. I had worked in Frankfort for LRC that spring, after quitting college at UK the previous fall, something I regret to this day. You might think at 19 I might have been one “tough son-of-a-bitch.” If I was, I would never say it, at least not in public. But, I wasn’t. Frankly, in the pic, weighing all of 135 pounds, my weight upon graduation from high school and for the three years following, I look rather stoned, which is well within the realm of possibility.

Bruce, if you will remind me, I’ll show it to you at the next Metro Dems meeting. Jacob, for you to see it will be a little more difficult. Since an April 30, 2009 email from you, I’ve obliged your specific request that I not have any words with you.
