Woops. Just saw your other comment.

Preston told folks he wrote an affidavit. And he admitted such to me. I saved all of my text messages from him. (Including the ones where he went batshit insane, threatening to sue me and such because I dared ask him to prove whatever evidence he said he had.)

After I called Preston out - without mentioning his name (you did that, just now), he called Jim King for sympathy.

If Preston has worked hard to protect his relationship, he probably shouldn't have sent me all kinds of text messages that were never off-the-record.

What occurred at the coffee shop: Preston drove around Java Brewing Company probably 20 or 30 times, repeatedly looking into windows. Which was quite interesting.

By the way - did you ever admit to Dan Borsch that you were, in fact, the guy telling me everything? Because you sure caused a lot of shit that I should have let you deal with on your own.

Cannot. Wait. To. Be. Deposed. Cannot wait.

I defended you throughout Jennifer Moore attempting to silence you. I reported the facts when she and her pals illegally ousted you from the SCEC. I stood up when people got in my face because I had the nerve to defend you.

But you're full of shit when it comes to Herndon. So you're walking on pretty thin ice, here, holmes.

Ken Herndon was stupid to believe I wouldn't publish everything I had. I quashed the subpoena with my attorney, Kif Skidmore, the infamous Lexington counsel you mention. (She happens to be one of the foremost attorneys in the country when it comes to media and freedom of speech.) Primarily because I wasn't notified in a timely manner and because it was ridiculous for either you or Ken Herndon to think I'd squeal on my sources.

No date was rescheduled, as Herndon's attorneys didn't file appropriate paperwork and I was *never* notified. But nice spin.

And, no, I wasn't set to be in Washington, D.C. I was tending to family.

I'd love nothing more than to be called. Because I have a lot of things to say that neither you nor Ken Herndon want to be public record in the form of a deposition. There is so, so, so much I'll say. But I'd bet money you're going to scramble to keep me quiet because it'll fuck both of your political worlds up. (Not the least of which is the prevailing opinion among several former Herndon supporters and a prominent union printer that Ken knew well in advance of the anti-gay mailer and then attempted to spin things his way.)

According to Herndon's counsel - and Jim King - they did not have his polygraph examination results prior to my publication.

I still think you should be ashamed for not having the balls to stand up to Jennifer Moore. You let me to do your dirty work. And now that you're standing behind Ken's retarded ass witch hunt - one that has forced you to ditch people who have been loyal to you for nearly your entire adult life - you should be even more ashamed. But that's just my opinion.

Cannot wait to be deposed. Cannot. Wait.

You've mentioned Preston, who is a friend of mine, and to my knowledge, a friend of Councilman King's. I'm not sure what went on between you and Preston at the coffeeshop. You alleged in your blog that he wrote an affidavit concerning the placement of the mailer in a particular place at a particular time. I have Preston's word, as does Councilman King, that such an affidavit from Preston does not nor ever did exist. I'm not sure why you alleged that. There is an affidavit out there alleging what you said it alleged. It is not Preston's and all parties involved, with you being the exception, are aware that it is not Preston's. Preston has actually worked very hard to protect his relationship with that might be called the "other side" in this matter.

Having said all this, I don't suppose you'll be asking to see my 1980 U of L ID pic anytime soon.

It's about three hours past my bedtime. We can take this up some other time.

I'm tempted not to respond to what you've written, but must.

Actually that isn't what you wrote and unless you "bcc'd" Ken, it was directed to me alone.

"Please don't contact me again, as everything will be on-the-record." You also wished me well with the KDP.

I have the email in my records.

Also, you didn't summarily quash the subpoena at all. I'm not sure why you believe you did. You were subpoenaed because Herndon's counsel thought you might have something more to offer. According to your Lexington counsel, you were to be out of town for a period of time, I believe in Washington DC, and she rescheduled your depo for later date in May; such date was later withdrawn by Herndon's counsel. Although it is unlikely, you may still be called as the case it yet underway to my knowledge. Your subpoena was recalled since the only information you had was the lie-detector test, something Herndon's counsel had already been provided by King's counsel before you published it in your blog.

I am hopeful that Ken will bring the investigation to a close, but I am also hopeful that he only does so after all avenues of information have been travelled. Although he was the only person to bring a case, he wasn't the only person injured by that mailer.

P.S. It was also around the same time the Preston kid was following me around and when Ken's attorney pals (one was your Metro Council boss) were trying like hell to figure out who I was talking with/who my sources were.

Lest anyone think I'm exaggerating, they were, indeed, attempting to discover my sources as they questioned Denise Bentley and others during depositions about whether or not they'd ever spoken with me and what they'd spoken with me about.

HA! I told you not to waste your time talking to me about anything related to Ken Herndon. If I remember correctly, it was after Ken was stupid enough to try to subpoena (which I summarily quashed) me for his little witch hunt and it was a message directed at you both.

I am often asked to provide photographic evidence of those happy days of long ago. Remember I was a teenager in the 1970s - everyone had plenty of hair. I have plenty of photos from my era with hair. So much so that I carry one such offering of proof on me at all times in my wallet, stuck somewhere between the King Southern Bank Debit Card and my ACLU membership card. I've been carrying the King Southern Bank card for about five years. I've been carrying the ACLU card for about as long as I been carrying the photo with the hair.

I've been proudly showing off this photo for years. I'm surprised that neither of you have ever seen it. The photo in question is on a University of Louisville ID card taken the summer of 1980 when I was 19. I had worked in Frankfort for LRC that spring, after quitting college at UK the previous fall, something I regret to this day. You might think at 19 I might have been one "tough son-of-a-bitch." If I was, I would never say it, at least not in public. But, I wasn't. Frankly, in the pic, weighing all of 135 pounds, my weight upon graduation from high school and for the three years following, I look rather stoned, which is well within the realm of possibility.

Bruce, if you will remind me, I'll show it to you at the next Metro Dems meeting. Jacob, for you to see it will be a little more difficult. Since an April 30, 2009 email from you, I've obliged your specific request that I not have any words with you. Other than this comment and two others in the last 72 hours, I've abided by your request. I'll agree to show you the ID if you'll lift the prohibition. Otherwise, you'll just have to use your imagination.

Damn I miss that hair. And where did this additional 105 pounds come from?

See, that's what makes reading this blog so worthwhile -- the image of Jeff Noble with an afro (or perm, as the case may be).

Wow. THAT went right into the file cabinet.
